After Market Extreme

I have a 30 day warranty (lemon law). I purchased a vehicle from a dealer that in the add said it had new tires. When they delivered my vehicle (2 1/2 hours away) I brought it to my mechanic. He said the tires were very worn and only had about 25% the tread left and that it would only last me through the summer. The dealer mislead me into believeing the tires were new which if i had of know it would of defintiely affected my decision on the purchas of the vehicle. He said he would not cover the tires because this is what the diclaimer said ”Prices , after market parts, options and extended warranties are subject to occasional error, please call if you have questions !! Staatsburg Motors reserves the right to exclude any after market warranties and added options. when sales prices are offered or negotiated.” Now if Im not mistaken the tires are not relevant to this disclaimer. He falsely stated the tires were new. I live in NY if this helps. Please let me know what I can do about this
